What is the penalty for an elected or an appointed official to refuse to honor their oaths of office? It depends. From what I can find, the constitution and amendments were signed by representatives of the several states and therefore are a contract between the States and the Federal government. Since the people of the various states were not included in the contract (their contracts being with the State), there may not be recourse by individuals to a federal official, such as the President, an appointed Federal officer or member of Congress who refuses to uphold the oath of office.
There may also not be a violation of the Oath of Office if one is not demanded to comply with the letter and intent of the sworn oath of office.
However, if a State demands that certain actions required by the Constitution or Federal statute be taken by an Elected or Appointed Official, and that person refuses to do as demanded by the States, then that person would be in violation of their Oath of Office and would be subject to removal from office and penalty, jail or both.
Where am I going with this? Well, Arizona has passed a law requiring persons not legally permitted to be in the United States and in violation of Federal immigration laws be turned over to the Federal authorities for deportation. In effect, the State of Arizona is DEMANDING that your elected and appointed Federal officials fulfill their oath of office to uphold the law of the land. At this point, certain federal officials have stated they would not fulfill their obligation to uphold federal immigration laws as demanded by the State of Arizona.
According to published reports, 17 additional states at this time are also discussing enacting similar legislation.
If Arizona and various other States demand compliance with existing Federal immigration statutes and POTUS Obama the Impotent Pantywaist Surrender Monkey* does not order his czar-minions to enforce the Constitution and existing Federal legislation, he then is technically in violation of his Oath of Office and is subject to immediate removal from office and subject to criminal penalties including both fine and jail.
